Criminal behaviour order for persistent street drinker
A man from Haverhill has been given a criminal behaviour order (CBO) for his anti-social disruptive behaviour and street drinking.
Neale Massie (pictured above) of no fixed abode but from Haverhill was imposed with the order on Wednesday, September 3, after police submitted an application at Ipswich Magistrates Court.
The order means he must not be possession of any opened or unopened vessel containing alcohol in any public place in Haverhill; that he must not consume any alcohol in any public place in Haverhill and must not join or remain in any group of three or more people, including himself.
Breaching a CBO is a criminal offence that can result in penalties, including imprisonment or a fine.
The maximum penalty for adults is up to five years in prison.
The outcome follows a robust crackdown on street drinking in Haverhill town centre.
Over the past three months community officers have issued eight Community Protection Warning letters with conditions.
Some of these have been breached by individuals, leading to an arrestable Community Protection Notice (CPN) being issued in five cases against five separate individuals.
Forty-two-year-old Massie was one individual who persistently breached his CPN on five separate occasions and the public spaces protection order (PSPO) against drinking in public.
He appeared before magistrates on August 20 and was fined £200 after being convicted by the court.
PC Jack Oakley who applied for the subsequent CBO and who gave evidence in court said: “Massie has been a prolific offender for a significant time in Haverhill with his disruptive and aggressive behaviour having a detrimental impact.
“The imposed conditions are designed to limit his opportunity to commit further offences.
“I am really pleased with this result which demonstrates our commitment to tackle these problems robustly.
“It is very positive news because it gives officers the power of arrest without the need for a substantive offence should he breach the order.”
